Fellow rider lost

    You may have heard about this already. If you haven't, I must sadly inform you that Tom Stagno, a member of the XJ Owners list and someone who frequented this forum, was killed on July 5th when a car driver illegally pulled out from a stop sign right into Tom's path. Tom collided with the right front of the car and died instantly. According to witnesses, Tom wasn't speeding and was wearing his gear.
    Maybe you knew Tom only online or not at all. I met him a few times at XJ Carb Clinics and he made a big impression. A fun loving, sweet and warm-hearted guy willing to help anyone, with a great sense of humor. And a devoted XJ man. He leaves behind a wife and two young children, along with a large circle of friends and associates. Tom will be mourned by many.
    Sorry I didn't post this earlier but Tom's wife didn't know his password to contact any fellow riders and didn't get his cell phone back from police until a few days ago.

    The driver was charged with a minor offense and fined $128. Outrageous, I know. However, police say "further charges are pending."
    Let's help make sure those "further charges" included Dangerous Driving Causing Death - which brings up to 14 years in prison - instead of the far less serious Careless Driving Causing Death - which brings a maximum 6 month in jail but is rarely applied. Dangerous Driving Causing Death is the province of Ontario equivalent to Vehicular Manslaughter. You can help by contacting the Crown Prosecutor for Essex-Windsor County here in the province of Ontario in Canada. Please help bring a little bit of justice for Tom.

    So we have to help make sure that the "further charges" are severe as possible - Dangerous Driving Causing Death. Please contact the Crown Attorney shown above to make sure he understands that until dangerous drivers face the most dire consequences possible for their actions, they won't take their offenses seriously.

    Thanks for bringing this to our attention, my condolences go out to his family in this time of hardship.

    Here in Ottawa there also have been questionable accidents involving cage drivers..... I myself have had 3 close calls due to people cutting me off or trying to over take my lane. one of my co-workers who is a labourer/carpenter always wears his steel toe boots back and forth to work and is ready to kick what ever comes in close contact to him.

    You are right about our laws here they are a joke at best..... i have read too many times about stories like these and i am sick and tired of people not getting what they deserve..... I will definetly be writing into the crown prosecutor, and will be forwarding this story onto all MC drivers i know...

    Again my prayers and wishes are with Tom's family....


    Is there a section here about fallen members, i have seen a similiar idea on another website once?

    128 is a foolish price slapped on a mans life..... may he Rest in Piece...

    by the way, what was his screen name?

    was the bike an 85 or 86 750?

    and ya.. that bike laying on the ground is kinda horrific

    Very sad. Condolances to his family and friends. My prayers are with them.

    Even though the drivers statement probably had the standard 4 words; "I didn't see him." Most likely it was; "I didn't look hard enough, (or at all)". And if he has a soul, this is something he will have to live with, criminal charges or not.

    Please be careful guys and gals. It is awfully saddening to lose any of you. Unfortunately we, as bike riders, must do our looking plus that of the cage driver.
