fool made me crash

    he made a left in front of me hesitated and went for it. i locked it up and crashed the asteroid bike. it was on my foot and gas was leaking out. i couldn't get it off but he got out and helped me. then he said "it wasn't my fault. i swerved to miss some kids" and drove away. there were no kids and if there were so what. he was turning on to his street. i found his house but i think a police report would not only mess him up bigtime but i'll bet it would cost me a load in insurence and stuff. i'm not sure what would be the best thing to do. i don't just want to feed lawyers and there's more to it than that. i don't just want to put a bundle into this bike. it will never be as cherry as it was. input?

    If you sustained injury and bike damage I for sure would get the cops and insurance involved.
    Peoples ignorance and not seeing are getting tons of people killed and injured, the more folks that make bikes wrek need to have a bit harsher penalties laid down so people will start driving more alertly.

    I concur, in my state any time you sustain any loss or injury over $500 by law you have to report it. He is not in to big of trouble be cause he did stop and render aid, but his insurance should pay for it. That is what they are there for. No lawyers should get involved unless they try to fight it which they wont because lawyers will cost them money.

    by the way zoooooot, are you in Cleveland, Oh. or Cleveland, Tx? I am looking for xj riders in the Cleveland, Tx area.

    Driving defensively is the best advice I have ever got. We all have to suffer the consecuenses of our descisions. Luckly you did not get hurt. Iam sure the guys did not have the intention to hurt you and it was nice for him to stop and help but I wil still file a police report and get my bike fixed by his insurance company. I agree no lawyer is involved unless you take him to small claims court.

    Definately have to get a report. He's already in trouble for leaving the scene of the accident.

    absolutely hands down get a police report and make sure HIS insurance pays for your bike to get fixed. It may take some time, the insurance companies will both do investigations and come to the conclusion that it was his fault and his insurance will have to pay. Although it was nice of him to at least acknowledge that he caused an accident, you also have the leverage that he left the scene without waiting for the police or to file a report, if he tries to fight it, because at least in Illinois, it's a big no-no to leave the scene of an accident. I was in an accident in my car last year where a woman pulled out and cut accross two lanes right in front of me (basically she was darting from a shopping center parking lot exit to the left turn lane of the road in which I was on) but we called the police right on the spot to file a report, our insurance companies both investigated and it was found to be 100% her fault and her insurance payed for it. It did take about 6 weeks, but it is worth it to be vigilant. Also, there has to be accountability when it comes to ignorance when driving, it has been said many times recently on other threads as well as this one that too many people simply claim "I didn't see the motorcycle" and people are dying. At least in Illinois (probably most states) ignorance of the law or being unaware or not seeing other vehicles ARE NOT viable excuses!

    Yes get the cops involved. He should be ticketed for failure to yield right of way. Maybe more complicated now that you left the scene and time has passed. Any other witnesses?

    File a police report. NOW. If you file first, hopefully they won't charge you both for leaving the scene of an accident.
